Purchase Options Cancellation Policy

MDHair.com is owned and operated by La Canada Ventures, Inc., a California corporation. In this Purchase Options Cancellation Policy, “MD Hair,” “we,” “us,” and “our” refer to La Canada Ventures, Inc.

This Policy applies to subscriptions, automatic-delivery programs, automatic-renewal arrangements, and other recurring purchase options offered through MDHair.com, collectively, “Subscriptions.”

This Policy does not apply to ordinary one-time purchases, except where expressly stated. One-time order cancellations, returns, refunds, and the Limited 60-Day MD® Satisfaction Guarantee are governed by our Return and Refund Policy.

By enrolling in a Subscription, you acknowledge and agree to this Policy, the Subscription terms displayed before checkout, our Terms of Service, Return and Refund Policy, Shipping Policy, Privacy Policy, and any product-specific or offer-specific terms presented before enrollment.

Important Subscription Summary

  • Your Subscription will continue, and your payment method will be charged at the frequency disclosed before enrollment until you cancel.
  • The product, recurring price, billing frequency, shipping charges, applicable taxes, introductory terms, and any minimum purchase obligation will be disclosed before you enroll.
  • Unless a specific offer clearly states otherwise before enrollment, there is no minimum number of shipments, no long-term commitment, and no cancellation fee.
  • You may cancel at any time to stop future recurring charges and shipments.
  • Subscriptions accepted online may be canceled online without calling or speaking with a representative.
  • Online cancellation is effective when you complete the cancellation process and receive confirmation.
  • Canceling a Subscription does not automatically cancel or refund a separate order that was already charged before the cancellation became effective.
  • Skipping or pausing a shipment is not the same as canceling the Subscription.

1. Subscription Offer Terms

Before you enroll in a Subscription, MDHair.com will clearly disclose the material terms applicable to the offer, including:

  1. The product or products included.
  2. Whether the Subscription continues until canceled or renews for a stated term.
  3. The recurring price or manner in which the recurring price will be calculated.
  4. The frequency of recurring charges and shipments.
  5. Shipping charges, if any.
  6. Applicable taxes.
  7. The duration of any introductory, promotional, trial, or discounted period.
  8. The price that will apply after any introductory or promotional period.
  9. Whether a free gift or bonus applies only to the first shipment.
  10. Any minimum purchase obligation, minimum term, or cancellation charge, if applicable.
  11. How to cancel the Subscription.
  12. Any other material restriction or condition applicable to the offer.

The terms shown for the specific Subscription on the product page, in the cart, at checkout, and in the enrollment confirmation form part of your Subscription agreement.

If an offer-specific term conflicts with this Policy, the more specific term controls only if it was clearly disclosed before you enrolled and is permitted by applicable law.

2. Affirmative Consent and Enrollment Confirmation

We will not enroll you in a Subscription or charge you on a recurring basis unless you affirmatively select the Subscription option and consent to its recurring terms.

Your affirmative consent may be obtained through an unchecked checkbox, button, selection, electronic acknowledgment, or another clear enrollment action presented with the Subscription terms.

Your consent to receive marketing communications is separate from your consent to enroll in a Subscription. Marketing consent is not required to purchase or maintain a Subscription.

After enrollment, we will provide an acknowledgment that you can retain, ordinarily by email or through your customer account. The acknowledgment will identify or provide access to:

  • The subscribed product.
  • The recurring price.
  • The billing and shipment frequency.
  • The automatic-renewal or continuous-service terms.
  • The applicable cancellation policy.
  • Instructions for managing and canceling the Subscription.
  • Our contact information.

We may retain records of your consent, enrollment, Subscription changes, and cancellation as required by law and as described in our Privacy Policy.

3. Recurring Payment Authorization

By enrolling in a Subscription, you authorize La Canada Ventures, Inc. and its payment processors to charge the payment method associated with your Subscription for:

  • The subscribed product.
  • Applicable shipping and handling.
  • Applicable taxes.
  • Any optional service you affirmatively select.
  • Any other charge clearly disclosed as part of the Subscription before you authorize it.

Charges will occur at the frequency selected and disclosed during enrollment.

Your authorization remains in effect until:

  • You cancel the Subscription.
  • We cancel the Subscription.
  • The Subscription expires under its stated terms.
  • The payment arrangement otherwise ends under applicable law.

The recurring price shown at enrollment will apply unless:

  • An introductory or promotional period expires as previously disclosed.
  • You affirmatively change the product, quantity, or frequency.
  • A permitted price change takes effect after legally required notice and, where required, consent.

Updating or replacing your payment method does not cancel your Subscription.

4. Introductory Prices, Discounts, and Free Gifts

A Subscription may include an introductory price, a discount, a free gift, a bonus product, complimentary shipping, or another promotional benefit.

Unless the applicable offer clearly states otherwise:

  • An introductory price applies only for the period or shipment identified in the offer.
  • A free gift or bonus product applies only to the first qualifying shipment.
  • A first-order discount does not apply to later renewal shipments.
  • Later renewal orders will be charged at the recurring Subscription price disclosed before enrollment.
  • A promotional gift is not redeemable for cash.
  • A gift or discount does not guarantee future product availability.
  • Cancellation does not entitle the customer to cash in place of an unused promotional benefit.

If a trial, free-to-paid offer, or temporary promotional price converts to a paid or higher-priced Subscription, the price after conversion and the cancellation method will be disclosed before enrollment.

5. How to Cancel a Subscription

You may cancel a Subscription at any time using any cancellation method made available for your Subscription.

A. Cancel Online

For a Subscription enrolled online, you may cancel online without calling or speaking with a representative.

You may ordinarily cancel by either:

  1. Signing in to your MDHair.com customer account.
  2. Selecting Subscriptions or Manage Subscription.
  3. Selecting the Subscription you wish to cancel.
  4. Selecting Cancel Subscription.
  5. Confirming the cancellation.

You may also use a Manage Your Subscription or similar link contained in an applicable Subscription email.

The online cancellation method will allow you to complete cancellation without being required to:

  • Call Customer Care.
  • Speak with a representative.
  • Provide a reason for canceling.
  • Complete a survey.
  • Purchase another product.
  • Accept a discount or retention offer.
  • Navigate through steps that unreasonably obstruct or delay cancellation.

We may require reasonable account authentication to protect your Subscription and payment information. If you are unable or unwilling to authenticate through the customer account, you may use another cancellation method stated below.

B. Cancel by Email

You may cancel by emailing:

Using the subject line "Cancel Subscription" will help us identify the request promptly, but the exact subject line is not required.

Your email should clearly state that you want to cancel the Subscription. When available, include:

  • Your full name.
  • The email address used for the Subscription.
  • Your order or Subscription number.
  • The product associated with the Subscription.

Do not send your full credit card number.

If the request is sent from the email address associated with the Subscription and we can reasonably identify the Subscription, we will not require unnecessary additional information.

If there are multiple Subscriptions associated with the customer or we cannot reasonably identify or authenticate the applicable Subscription, we may request only the information reasonably necessary to complete the cancellation.

A complete email cancellation request will be processed promptly and ordinarily no later than one business day after receipt.

C. Cancel by Mail

You may mail a written cancellation request to:

Include your full name, email address, mailing address, and order or Subscription number, if available.

A mailed cancellation becomes effective when it is received and reasonably identified by us, not when it is deposited with the postal service. We recommend using a trackable delivery method.

6. Cancellation Effective Date and Confirmation

An online cancellation is effective when:

  1. You complete the online cancellation process; and
  2. The Site displays or sends a cancellation confirmation.

Once cancellation is effective:

  • No additional recurring orders should be created under the canceled Subscription.
  • No additional recurring charges should be made under the canceled Subscription.
  • No additional future shipments should be scheduled under the canceled Subscription.

An email cancellation is effective when we receive a clear, readable request and can reasonably identify the Subscription. We will not delay cancellation by requesting information unrelated to identification, authentication, or the customer’s stated request.

A mailed cancellation is effective when received and reasonably identified.

We will provide confirmation of cancellation through the Site, email, or another retainable communication.

There is no fee to cancel a standard Subscription.

A post-cancellation survey or request for feedback is optional and does not delay or reverse cancellation.

If a recurring charge is processed after a valid cancellation became effective, contact customercare@mdhair.com. After verification, we will correct the charge as required by applicable law and this Policy.

7. Cancellation of a Subscription Versus Cancellation of an Order

Canceling a Subscription stops future recurring charges and shipments. It does not necessarily cancel a separate order for which payment was successfully processed before the Subscription cancellation became effective.

For example:

  • Subscription canceled before the next recurring charge: The upcoming renewal should not be charged or shipped.
  • Subscription canceled after a renewal charge was successfully processed: The Subscription is canceled for future renewals, but the already-created order remains separate.
  • Subscription canceled after an order shipped: The shipment cannot be stopped through Subscription cancellation.

If a renewal order was charged before you canceled the Subscription, you may separately request cancellation of that order under the Return and Refund Policy.

Ordinary order-cancellation requests may be submitted within 24 hours of an order being placed or created, but cancellation is not guaranteed once the order enters warehouse or fulfillment processing. An order cannot be canceled after it has shipped or been tendered to the carrier.

Canceling a Subscription is not the same as requesting a return or refund.

8. Returns and Refunds for Subscription Orders

Subscription orders are subject to the Return and Refund Policy.

Unless an exception or applicable law applies:

  • An unopened Subscription product may be eligible for return if the return request is initiated within 30 calendar days of the ship date shown in the shipping confirmation email.
  • The product must be unused, unopened, factory sealed, and in its original packaging.
  • Prior Return Authorization is required.
  • Original shipping, handling, expedited delivery charges, and optional package protection charges are generally nonrefundable.
  • The customer is generally responsible for return shipping unless the return is due to a verified MD Hair shipping error or a verified manufacturer defect.

The Limited 60-Day MD® Satisfaction Guarantee applies only under the requirements and limitations stated in the Return and Refund Policy.

For a Subscription, the Limited 60-Day MD® Satisfaction Guarantee applies only to the first qualifying shipment of the applicable product. It does not create a satisfaction-guarantee refund right for every renewal shipment.

Cancellation alone does not create a retroactive right to refund:

  • Products already shipped.
  • Products already delivered.
  • Products already used.
  • Prior Subscription charges.
  • Prior shipping charges.
  • Promotional benefits already received.

Nothing in this section limits a refund or remedy required by applicable law.

9. Skipping, Pausing, Rescheduling, and Changing a Subscription

Depending on the Subscription platform and offer, your account may allow you to:

  • Skip an upcoming shipment.
  • Pause the Subscription.
  • Resume a paused Subscription.
  • Change the next billing or shipment date.
  • Change the delivery frequency.
  • Change the quantity.
  • Change an eligible subscribed product.
  • Update the shipping address.
  • Update the payment method.

Skipping

Skipping an order generally affects only the selected upcoming shipment. The Subscription remains active and recurring charges and shipments resume according to the schedule shown in your account.

Skipping is not cancellation.

Pausing

Pausing temporarily suspends future recurring charges and shipments until the Subscription is resumed, subject to the options displayed in your account.

Pausing does not cancel the Subscription.

A pause does not automatically cancel or refund an order that was charged before the pause became effective.

Resuming

When you resume a paused Subscription, recurring charges and shipments will restart according to the schedule and terms displayed before you confirm resumption.

Changes

A requested change ordinarily applies only to future orders. A change to a product, address, quantity, frequency, or payment method may not affect an order that has already been charged or transmitted for fulfillment.

Review the next scheduled order information after making any change.

10. Failed Payments and Billing Retries

If a recurring payment is declined or cannot be processed, our payment processor or we may:

  • Notify you of the failed payment.
  • Request that you update the payment method.
  • Retry the payment method.
  • Delay the shipment.
  • Pause the Subscription.
  • Cancel the Subscription after unsuccessful retry attempts.

We do not charge a separate MD Hair late fee for a failed Subscription payment unless a different fee was clearly disclosed and lawfully authorized before enrollment.

A third-party bank, card issuer, installment provider, or payment service may independently impose fees under its own agreement with you.

You may cancel the Subscription while a payment failure is pending. A valid cancellation will stop future billing attempts associated with renewals that have not already been successfully charged.

If a payment is successfully processed before cancellation becomes effective, the resulting order is governed by Section 7 and the Return and Refund Policy.

11. Product Availability and Discontinuation

Subscription products remain subject to inventory availability.

If a subscribed product is unavailable, discontinued, recalled, materially reformulated, or cannot legally be shipped to the destination, we may:

  • Delay or skip the affected shipment.
  • Pause the Subscription.
  • Contact you regarding available options.
  • Request consent to substitute an eligible product.
  • Cancel the affected Subscription.

We will not knowingly substitute a materially different product and charge you for it without appropriate notice and consent.

A nonmaterial update to packaging, labeling layout, container design, or branding does not necessarily constitute a product substitution.

If we charge for an order that we cannot fulfill, we will issue an appropriate refund.

12. Price and Material-Term Changes

We may change a Subscription price or another material term only prospectively and in accordance with applicable law.

Before a new recurring price takes effect, we will provide clear notice identifying:

  • The existing or affected Subscription.
  • The new price or manner of calculating the price.
  • The date the change will take effect.
  • How to cancel before the change applies.

Where required by law, we will obtain affirmative consent to the change.

For a qualifying California consumer Subscription, notice of an accepted fee change will be provided no fewer than 7 days and no more than 30 days before the fee change takes effect.

A material-term-change notice will be sent in a form that can be retained, ordinarily by email or through the customer account.

No price change will retroactively increase the price of an order that has already been charged.

If you do not agree to a proposed change, cancel the Subscription before the change takes effect.

13. Renewal, Trial, and Annual Reminder Notices

We will provide renewal and reminder notices when required by applicable law.

Annual Reminder

At least annually while an applicable Subscription remains active, we will send a reminder that identifies:

  • The subscribed product.
  • The frequency of recurring charges.
  • The amount of the recurring charges or applicable pricing information.
  • How to cancel the Subscription.

Long-Term Automatic Renewals

If a Subscription has an initial term of one year or longer and automatically renews, we will provide a renewal notice at least 15 days and no more than 45 days before the applicable renewal.

Extended Trials or Promotional Periods

If an automatic-renewal or continuous-service offer includes a free trial, a free-to-paid conversion, or a temporary promotional or discounted-price period lasting more than 31 days, we will provide the legally required notice at least 3 days and no more than 21 days before the free trial, free-to-paid conversion, or promotional or discounted-price period expires.

Electronic Notices

When a notice is sent electronically, it will include a direct cancellation link or another reasonably accessible electronic method to initiate or complete cancellation.

Additional upcoming-order or upcoming-shipment reminders may be sent even when not legally required.

14. Retention Offers and Cancellation Information

We may explain the effect of cancellation or present an optional discount or customer benefit during the cancellation process only where permitted by law.

Any such information or offer will not:

  • Remove the cancellation option.
  • require acceptance or rejection before cancellation.
  • require a telephone call.
  • require interaction with a representative.
  • unreasonably obstruct or delay cancellation.

A clearly identified cancellation button or link will remain available while any optional retention offer is displayed.

You may proceed directly to cancellation without accepting another offer.

15. Prepaid Plans and Other Purchase Options

Unless an offer expressly states otherwise before checkout, MDHair.com Subscriptions are pay-per-delivery arrangements under which the applicable payment is charged before each scheduled shipment.

If MDHair.com offers a prepaid Subscription, preorder, reserve-now arrangement, or try-before-you-buy option, additional terms will be presented before purchase.

Those terms may address:

  • The amount charged at enrollment.
  • The number and timing of scheduled shipments.
  • Whether future scheduled deliveries may be canceled.
  • Refund treatment for unfulfilled prepaid deliveries.
  • When a later payment will be charged.
  • Whether the arrangement automatically renews.
  • How to cancel any automatic renewal.

This Policy does not, by itself, create or guarantee the availability of a prepaid plan, preorder, or try-before-you-buy program.

If another purchase option includes an automatic-renewal or continuous-service feature, the cancellation protections in this Policy apply to that feature.

16. Cancellation or Suspension by MD Hair

We may cancel, suspend, or decline to renew a Subscription for legitimate reasons, including:

  • Repeated payment failure.
  • Product discontinuation or unavailability.
  • Product recall.
  • Shipping or legal restrictions.
  • Inability to verify payment or account information.
  • Suspected fraud or unauthorized payment activity.
  • Unauthorized resale or diversion.
  • Abuse of discounts, gifts, refunds, guarantees, or Subscription benefits.
  • Violation of our Terms of Service.
  • Conduct that creates a material safety, legal, security, or operational risk.

If we cancel a Subscription:

  • No additional recurring charges will be made after cancellation.
  • Any order that is already charged and that we cannot or will not fulfill will be appropriately refunded.
  • Any refund for a completed or shipped order remains subject to the Return and Refund Policy and applicable law.

Cancellation by MD Hair does not limit any rights or remedies arising from conduct occurring before cancellation.

17. Unauthorized Subscriptions or Charges

Contact us promptly if you believe:

  • You did not enroll in a Subscription.
  • A recurring charge was not authorized.
  • A canceled Subscription continued to be charged.
  • A Subscription was created through misuse of your account or payment method.
  • The product, price, or frequency charged differs materially from what you authorized.

Email customercare@mdhair.com and include your name, the email address associated with the transaction, and the relevant order information.

Do not send your full payment card number by email.

We may request reasonable information to verify the account and investigate the transaction. We may also provide relevant records of consent, orders, shipments, accounts, and cancellations to a payment provider investigating a charge.

Nothing in this Policy limits a lawful right to report or dispute an unauthorized charge with your financial institution.

A customer may not knowingly obtain both a merchant refund and a chargeback credit for the same charge.

18. Customer Account and Contact Information

You are responsible for maintaining accurate:

  • Email information.
  • Shipping information.
  • Billing information.
  • Payment information.
  • Account-access information.

Subscription confirmations, reminders, price-change notices, renewal notices, failed-payment notices, and cancellation confirmations will ordinarily be sent to the email address associated with the Subscription.

Update your information promptly through your account or by contacting Customer Care.

Failure to review an email does not extend a billing, shipping, return, or cancellation period, except where applicable law requires otherwise.

We may require reasonable authentication before disclosing, changing, or canceling Subscription information.

19. Mandatory Consumer Rights

Nothing in this Policy excludes, restricts, or modifies:

  • A cancellation right that cannot lawfully be waived.
  • A right concerning unauthorized recurring charges.
  • A statutory warranty or consumer guarantee.
  • A legally required refund or remedy.
  • A right provided under the law of the consumer’s jurisdiction that cannot lawfully be limited.

Where applicable law provides greater protection than this Policy, the applicable mandatory law controls.

20. Changes to This Policy

We may update this Policy prospectively to reflect changes in law, Subscription functionality, business operations, or available purchase options.

The updated Policy will be posted with a revised “Last Updated” date.

Where required by law, we will provide additional notice of a material change.

A revised Policy will not retroactively authorize a recurring charge or materially reduce a right that became fixed before the revision, except where required by law or affirmatively accepted by the customer.

Price changes, material Subscription changes, and automatic-renewal notices will also be handled in accordance with Sections 12 and 13.

21. Relationship to Other Policies

This Policy governs Subscription enrollment, recurring billing, management, and cancellation.

The Return and Refund Policy governs:

  • Return eligibility.
  • Refund eligibility.
  • The Limited 60-Day MD® Satisfaction Guarantee.
  • Damaged or defective products.
  • Ordinary order-cancellation requests.
  • Already-processed Subscription orders.

The Shipping Policy governs shipping, delivery, carrier, loss, address, and package-related matters.

The Terms of Service govern Site use, payment obligations, intellectual property, warranty disclaimers, limitations of liability, dispute resolution, and other legal terms.

The Privacy Policy governs our handling of personal information.

Where policies conflict, the policy addressing the more specific subject controls, subject to applicable law.
